Rental Terms:

1. Cancellation Policy:

In the event of a cancellation by the lessee before the equipment has been shipped, a cancellation fee of $50 or 20% of the initial rental fee, whichever is greater, will be charged to your credit card. If the order has already been shipped and is refused by the lessee, the full initial rental fee will still be charged.

2. Terms of Agreement:

During checkout, you will be asked to confirm that you have read and understand the terms of this agreement.

3. Projector Rentals:

All projector rentals include power supply, instruction manual, remote, original cabling, and carrying case unless otherwise specified.

4. Screen Rentals:

All screen rentals include only the screen and its transporting case unless otherwise specified.

5. Lessee Responsibility:

The lessee is responsible for the care and return of all items shipped to them under this rental agreement. If an item is damaged by the lessee, they will be charged for the full "replacement cost" under this agreement. This cost is equal to the price charged by the original supplier to replace the item with the exact model or its newer version if the particular model is not being sold anymore. If lessee returns the item without using the pre-paid return label, then any applicable charges will be billed to the lessee for the return delivery. Lessee may not return any items in any manner other than through the included return instructions. ALL ITEMS ARE DOCUMENTED ON THE DAY THEY LEAVE OUR WAREHOUSE VIA A DIGITAL PHOTOGRAPH OF CONDITION. ALL EQUIPMENT IS INSPECTED TO DETERMINE IT IS IN PROPER WORKING ORDER BEFORE LEAVING OUR FACILITY.

6. Support:

The lessor is only responsible for support related to hardware issues. Software and presentational support are not available.

7. Rate Quoted Includes:

The rate quoted for the rental period includes shipping both ways; to the customer and back to Projector-Rental.NET, unless priority overnight is selected, in which case an additional charge per item shipped will be added based upon Federal Express's current rates. The price does not include consulting, teaching, set-up or any other related service which could be performed. Lessee agrees to arrange these services on their own and does not expect Projector-Rental.NET to perform any of these functions. However, the rate does include free hardware support via email.

8. Delivery Times:

All shipments are delivered via Federal Express and should arrive by 3:00pm (destination time zone). Priority shipments should arrive by 10:30am (destination time zone). These times are guaranteed through Federal Express, and if the shipment can be proven late then the entire delivery fee of that delivery will be refunded to the customer by Projector-Rental.NET. If the delivery is late and you wish to file a complaint, please call 1-800-GO-FEDEX and they will assist you in your claim. A Federal Express representative will come to your location and you will have to file a claim. Once your claim that the package was delivered late is confirmed by Federal Express to us, an appropriate refund of that delivery charge will be issued to your credit card. The only time Federal Express's guarantee is not honored is through "acts of nature" including severe storms and extreme conditions, but not limited to those situations.

9. Conditions:

Projector-Rental.NET assumes no responsibility nor guarantees any particular level of presentational conditions. It is the lessee's responsibility to determine whether or not proper presentational conditions will be available in their particular destination.

10. Pre-Paid Return Label:

In the event that the lessee loses the pre-paid return label, the lessee will be resposible for all charges incurred to return the item standard overnight on the appropriate return date/time to Projector-Rental.NET.

11. Early Termination:

In the event that the lessee returns the equipment before its due date, no credit or refund will be issued.

12. Late Return:

In the event that the lessee returns the equipment late, it is assumed that the rental period has been extended and a new rental period has occured. Therefore, unless the lessee has notified Projector-Rental.NET, the rental period will be extended and the lessee is responsible for all appropriate charges to extend the rental. Please contact us if you know that you're going to be late returning the equipment and we'll try to work something out.

13. Rental Period:

The rental period selected begins on the "Rent From" date and ends on the "Rent To" date as selected on the site's calendar. The rental period starts at 3:00pm on the "Rent From" date and the item must be dropped to Federal Express on the "Rent To" date by the appropriate pickup time in the lessee's area. Most drop boxes have a cut off time of between 5:00pm-7:00pm, but we do not guarantee these times.

14. Credit Card Charges:

Your credit card will be billed for the entire rental amount immediately upon confirmation of your rental reservation either online or via telephone. Credit cards accepted include Visa, Mastercard, AMEX, and Discover. Any refunds issued will be back to the original credit card and will not be given in any other manner. Your credit card is used as a form of security, and any charges for lost and/or damaged equipment will be billed to the card if appropriate.

15. Lessor Responsibility:

Lessor agrees to send the appropriate equipment as listed in the item's description. The lessee is responsible to determine what hardware and/or software will be required to perform their desired tasks. We are only responsible to send what the customer orders. Lessor agrees to provide all equipment in proper working order and if proof can be made that this promise is violated, a full refund shall be issued.

16. Substitution:

Lessor reserves to the right to substitute equipment as long as the replacement item meets or exceeds the specifications of the original equipment reserved. Equipment that does not meet the original's specifications shall not be used as a substitute.

17. Defect Notice:

Lessee is required to inform the lessor of any defects or damage they believe occured during shipping or at any other period while the item was in their possession within 24 hours of receiving the equipment. Otherwise, it is assumed that the equipment was delivered in perfect working condition without defects or damage.

18. Risk of Loss and Theft:

The lessee bears the entire risk of loss and/or theft while the equipment is in their possession. Any revenues lost by Projector-Rental.NET will be charged to the lessee for equipment that not been returned and has not been replaced yet by the lessee.

19. Limit of Liability:

Projector-Rental.NET is owned by a limited liability company, Superior Retail LLC. We are not responsible nor liable for any losses incurred by late equipment, including but not limited to lost revenues, lost promotions, lost compensation, or any other type of loss incurred as a result of the equipment either being late or not showing up at all. Lessee agrees to forfeit their right to sue us for any damages caused by the equipment at any time. Lessor is not liable for any loss of potential revenue or loss of time.

20. Ownership:

The equipment's ownership shall remain with the lessor at all times during the rental period.

21. Legal Fees:

Lessee agrees to pay any legal fees incurred to either seize equipment or to recover money owed to Projector-Rental.NET by the lessee. Lessee agrees to pay any other costs associated with such recovery of equipment and/or money owed to the lessor. Lessee agrees to pay all legal fees of Projector-Rental.NET in the event that the lessee suits under breach of contract or suits under any other circumstance. Lessee hereby waives trial by jury.

22. Return of Equipment:

Lessee agrees to return equipment in original box with original packing materials. Lessee agrees to return equipment in manner pre-determined by Projector-Rental.NET (Pre-Paid Federal Express). A $20 fee will be incurred by the lessee for violation of this part of the rental agreement.

23. Damages:

Lessee is responsible for any damage incurred above and beyond what is deemed normal wear and tear by Projector-Rental.NET.

24. Maintenence:

Lessee is entitled to free maintenence during rental period due to any cause other than their own negligience.

25. Repairs:

Lessee may not have the equipment serviced or service the equipment themselves unless prior consent is issued by the lessor.

26. Location:

Equipment may not be taken outside North America.

27. Agreement:

I have read and agree to the rental agreement and terms listed herein. I agree to have all unpaid appropriate charges billed to my credit card. If the credit card will not accept such charges, then legal action will be taken to recover charges plus any revenues lost by Projector-Rental.NET not having the mentioned equipment.

Notice:

In this agreement, the term "lessor" refers to Projector-Rental.NET and the term "lessee" refers to the recipient of the rental equipment. By reserving a rental, you agree to this rental agreement and its terms listed above.
